This summer, the Paul-Andr茅 Cr茅peau Centre for Private and Comparative Law is presenting its second series of Summer Seminars in which the whole 平特五不中 Law community is invited to take part. The main purpose of this series is to offer a forum to younger scholars to present their ideas and to engage with those of others in an informal setting.
This Summer Seminar will be given by Caroline Le Breton-Pr茅vost, LLM candidate at 平特五不中 Law.
Abstract
(In French only) L鈥檕bligation de loyaut茅, apparue dans le droit commun qu茅b茅cois avec l鈥檃v猫nement du Code civil du Qu茅bec (CcQ) en 1994, est un concept encore n茅buleux en droit priv茅 qu茅b茅cois. Il est utile, afin d鈥櫭ヽlairer ce concept, de retracer ses origines qui t茅moignent de l鈥檌nteraction entre le droit civil et la common law au Qu茅bec. Le fait que la common law ait jou茅 un r么le dans l鈥櫭﹎ergence de l鈥檕bligation de loyaut茅 en droit qu茅b茅cois en fait une pr茅cieuse source d鈥檌nspiration dans l鈥檌nterpr茅tation de ce concept. Il est 茅galement n茅cessaire, afin de comprendre le concept de loyaut茅, de cerner certains obstacles qui nuisent 脿 sa reconnaissance en droit priv茅 qu茅b茅cois. Finalement, en extrapolant 脿 partir des quatre situations dans lesquelles une obligation de loyaut茅 est explicitement pr茅vue par le CcQ (administration d鈥檜ne personne morale, administration du bien d鈥檃utrui, contrat de travail et mandat), l鈥檕n peut tenter d鈥檈squisser les contours d鈥檜ne th茅orie g茅n茅rale de la loyaut茅 en droit priv茅 qu茅b茅cois.
Speaker bio
Caroline Le Breton-Pr茅vost received her bachelor's of law from the Universit茅 Laval in Quebec in 2010. After completing her training at the 脡cole du Barreau and an internship at Tremblay Bois Mignault Lemay avocats, she received her J.D. in North American Common Law from the Universit茅 de Montr茅al. She is currently finishing her LL.M. in Comparative Law at 平特五不中. She is interested in the areas of comparative and private law.
