Overview
Law General : Examination of the basic principles of international investment law and investor-state dispute settlement (ISDS). Focus on substantive obligations, such as the obligation to afford fair and equitable treatment and not to discriminate on the basis of nationality, found in bilateral investment treaties (BITs), as well as on customary international law protections. Introduction to ISDS, including arbitration at the International Centre for the Settlement of Investment Disputes, as well as proposals such as the multilateral investment court championed by the European Union. The environmental and social issues surrounding international legal protection of foreign investment and proposals for modifying it.
